General Terms and Conditions (GTC)
§ 1 Scope
The following General Terms and Conditions (GTC) in the version available on the Internet at the time of the order apply exclusively to business relationships between Brickreke and the customer. These can be saved or printed out by the customer on their computer for the purpose of online ordering. The online shop is available in German, the contract language is German.
§ 2 Contracting party
The customer's contracting party is the company Brickboxreke, based in Germany, Siedlungsstraße 48 09468 Tannenberg
§ 3 Conclusion of the contract
By clicking on the button "buy" / "order now" the customer submits a binding contract offer. Before sending the order the customer can change and view the data at any time, identify any errors and correct them before the binding final submission of the order. Brickboxreke will immediately confirm receipt of the order to the customer by email. Confirmation of receipt of the order does not constitute acceptance of the contract. The contract is concluded when the order placed by the customer via the Internet is accepted by delivery of the goods or by notification of delivery.
The customer receives all contract data, i.e. billing and delivery address, payment method, the selected product and the costs of the order including shipping costs and VAT and the expected delivery date again in a confirmation email. The customer can also view the information via his customer account.
§ 4 Delivery and shipping
The goods are delivered in accordance with the provisions set out on the website, unless otherwise agreed between the customer and Brickboxreke. The delivery time is agreed individually or is specified in the ordering process.
In general, a delivery time for display cases of up to 28 working days from receipt of payment applies.
Bulky goods: For bulky goods display cases (Eiffel Tower etc.) it can take longer than 28 working days due to material procurement and special shipping. We state up to 90 working days here. In general, we only deliver display cases in perfect quality. If you have any questions, please do not hesitate to call us. You can find our telephone number under Contact.
§ 4.1 Right of return
The company Brickboxreke grants the customer a 14-day right of return. If you would like to send us a return, request your return label at: support@brickboxreke.de - we will then explain the process to you and send you the label. Please do not send us any returns without informing us in advance! After we receive the return, we will of course transfer your money back to you within 5 working days.
§ 5 Payment agreement
When placing the order, the customer indicates whether he would like to pay either by advance payment/bank transfer or online payment. With the online payment method, the customer authorizes the payment either by entering the bank, credit card details or access data of a payment service provider. In the case of online payment, the customer expressly authorizes the contractual partner to collect the amount due as part of the order. If the collection of the payment fails for reasons for which the customer is responsible, the customer must reimburse the chargeback costs and any bank processing fees incurred. The well-known direct debit authorization (ELV) was replaced in February 2014 by the SEPA direct debit. When making an online payment, the customer expressly agrees to the new procedure and gives the provider or their representative a SEPA direct debit mandate (§127 BGB). The mandate issued is valid for the order (one-time mandate). With the shipping confirmation, the customer receives advance notification of the creditor identification number, the mandate reference, the amount and the time of the upcoming SEPA direct debit (pre-notification). The provider or their representative shortens the lead time for the direct debit to 3 days. The invoice amount due is debited from the customer's account by the provider or their representative, stating the bank details and the mandate reference. The SEPA direct debit can be revoked within 8 weeks of the debit date. The claim remains unaffected. For logistical reasons, the provider reserves the right to send the invoice in electronic form. In this case, the invoice is sent by email and is free of charge.
§ 6 Retention of title
Until all goods from the same order have been paid for in full, the goods remain the property of Brickboxreke.
§ 7 Complaints / Dispute resolution
From February 15, 2016, the EU Commission will provide a platform for out-of-court dispute resolution. This gives consumers the opportunity to resolve disputes in connection with their online order without initially involving a court. The dispute resolution platform can be reached via the external link http://ec.europa.eu/consumers/odr/.
§ 8 Final provisions
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory provisions of the state in which the customer has his habitual residence remain unaffected.
If the customer has no general place of jurisdiction in the country or if he has moved his place of residence abroad after the conclusion of the contract or if the place of residence is not known at the time the action is brought or if the customer is a merchant and acts in this capacity, the place of jurisdiction for all disputes is the registered office of UNIQUEWALL.
If individual provisions of this contract with the customer, including these general terms and conditions, are or become invalid in whole or in part, this shall not affect the validity of the remaining provisions.
